Conditions of sale by private treaty in the proceedings number I
I). Subject of sale: Ownership rights to land plot no. 100/3, land registry district 002, located in the Lodz Voivodeship, Opoczno County, Zarnow Municipality, in the locality of Africa, with a total area of 3.6 ha, for which the District Court in Opoczno, V Land Registry Department maintains land register KW no. PT1O/00037181/5.
II). Identification of the bankrupt: Jolanta Cwiklowska, residing at 59-220 Legnica, Wojciech Korfantego Street 3/6.
III). Identification of the Court and case number: District Court in Legnica, V Economic Department, Zlotoryjska Street 19, 59-220 Legnica, Case No. LE1L/GUp-s/55/2025.
IV). Basis for disposal: Article 491(11a) paragraph 2 of the Bankruptcy Law of February 28, 2003 (Journal of Laws 2024.794 consolidated text).
1). The sale takes place by private treaty, in a public offer.
2). The sale may occur for the highest price obtainable on the market, but not lower than 120,000.00 PLN.
3). The procedure for the sale by private treaty is written, offer-based – subject to point 17 of these conditions of proceedings.
4). The offer with the highest proposed sale price binds the bidder and constitutes the most advantageous offer in the course of the offer proceedings for the sale of the subject of the proceedings – until the resolution of any auction referred to in point 17 of these conditions of proceedings.
5). Participants in the proceedings must, under penalty of exclusion from participation, pay into the bankruptcy estate bank account (account number: 84 1020 5242 0000 2602 0689 6619) a deposit by August 19, 2025 in the amount of 12,000.00 PLN.
6). The deposit paid by the bidder whose offer was selected is credited towards the purchase price, and if the sale agreement is not concluded within two months from the date of approval of the selection of the offer by the Commissioner Judge due to the fault of the bidder, the deposit is forfeited to the bankruptcy estate. Other bidders will have their deposits returned within 14 working days from the approval of the offer.
7). The bidder whose offer was selected is obliged to conclude the sale agreement within two months from the date of approval of the selection of the offer by the Commissioner Judge and by the date of concluding the agreement must pay the entire offered price.
8). The costs of verifying the subject of sale and concluding the agreement are borne by the buyer.
9). The buyer agrees to exclude liability for physical and legal defects of the subject of sale.
10). The terms of the sale agreement established by the syndic are not subject to negotiation; the syndic is entitled to choose the notary before whom the activities related to the sale will be performed.

12). An offer not containing at least one of the above will not be considered.
13). Submission of one offer is sufficient to effect the sale.
14). Offers in Polish or translated into Polish by a sworn translator in sealed envelopes preventing their opening with a clear and legible identification of the bidder, as well as with the note "Proceedings for sale - LE1L/GUp-s/55/2025 – DO NOT OPEN" must be submitted by August 19, 2025 to the address: Syndic Office, Court Supervisor, Manager Dr. Michal Blaszczyszyn, PO Box 102, 53-350 Wroclaw 15. The date of receipt is decisive.
15). The opening of offers will take place on August 21, 2025, at 9:30 AM, location of the opening of offers: Syndic Office in the presence of all interested parties.
16). The opening of offers will be conducted in terms of compliance with the conditions of the offer proceedings, which are specified above and the proposed purchase prices.
17). In the case of equivalent offers, an oral auction may be held on August 21, 2025, at 9:45 AM, location of the auction: Syndic Office with the following conditions:
18). The selection of the most advantageous offer will be made by the syndic, the selection requires the approval of the Judge-Commissioner.
19). The price must be paid no later than at the time of concluding the agreement – before its conclusion.
20). In matters not regulated by these conditions, the provisions of the Bankruptcy Law and the provisions of the Civil Code shall apply accordingly.
21). The possibility of canceling in whole or in part the sale proceedings or its annulment at any stage of the proceedings without giving reasons is reserved.
